  1. Please read these Terms and Conditions carefully before using the allfed.info website ("the Website") operated by ALLFED Institute, a nonprofit corporation and tax-exempt 501(c)(3) public charity in the USA (EIN# 83-1717756).
  2. References to "ALLFED", "Alliance to Feed the Earth in Disasters", "our", "we", or "us" in these Terms and Conditions are references to the ALLFED Institute.
  3. These Terms and Conditions additionally relate to our other ALLFED entities represented through the Website:

    2. ALLFED Australia (ABN: 77 665 711 151);
    3. Where specific regional terms and conditions apply, these are named in this document.
  4. By using or accessing the Website, you agree to be legally bound by these Terms and Conditions.
  5. If you do not wish to be bound by these Terms and Conditions, you should not use the Website.

Nature of the Website

  1. The Website:
    1. provides information about ALLFED, the work we carry out, and our supporters;
    2. provides you with online resources, information, and news;
    3. enables you to register for our newsletter;
    4. enables you to send us your comments and questions via the ALLFED Contact Us form.

  1. You may not alter the Website in any way, post onto it, or transmit to the Website any material containing software viruses or files that may damage or disrupt the good working order of computer or telecommunications equipment.
  2. ALLFED reserves the right at any time and without prior notice to replace or amend these Terms and Conditions by posting amendments or a new set of terms and conditions on the Website.   1. While ALLFED shares peer-reviewed research and other information intended to be as accurate as possible.
  2. ALLFED does not guarantee that the information contained in the Website is accurate, comprehensive, verified, or complete and accepts no liability if any person or organization relies on or uses the information.
  3. ALLFED does not guarantee that the functions or materials accessible from or contained in the Website will be uninterrupted or error-free, that defects will be corrected, or that the Website or the Website servers that makes it available are free of viruses or faults.

  1. The contents of the Website are protected by United States and United Kingdom international copyright laws and other intellectual property rights. The owners of these rights are ALLFED, its affiliates, or other third-party licensors. No content from the Website may be copied, used, or reproduced without our written consent and the written permission of the owners of the Intellectual Property Rights in the content. Please send your written requests to use content from the Website using the email form on the Contact Us page.
  2. You may link to the ALLFED Website, Website Materials, Name and Logo, and Intellectual Property Rights provided that:

Donations

  1. You are welcome to make donations to ALLFED via the Website’s donations page and the payment methods specified therein. These are subject to a periodic review and we welcome your feedback on it.
  2. ALLFED will use all donations in a manner that furthers its charitable objectives.
  3. You represent and warrant that: (a) any donations you make through the ALLFED Website do not violate any Law or any rights of any third parties.

Applicability of online materials

  1. The Website is controlled and operated by ALLFED. Where content on the Website is supplied by others, we do not control or endorse such content in any way.
  2. We believe the Website complies with U.S. laws and, where applicable, the laws relevant to jurisdictions of other ALLFED entities. However, we cannot guarantee that it is appropriate or available for use in every territory outside the U.S.
  3. Those who visit the Website from other territories are responsible for compliance with all laws that may be applicable to them. If use of the Website and/or viewing of it, or use of any material or content on the Website or services, are contrary to or infringe any applicable law in your jurisdiction(s), you are not authorized to view or use the Website, and you must exit immediately.

  1. ALLFED makes no representations whatsoever about any other websites. When you access any website through the Website, you understand that it is independent of ALLFED and that we have no control over its content, availability, or the services offered through the website.  
  2. A link to any other website through the Website does not mean that ALLFED endorses or accepts any responsibility for the content or the use of such a website. ALLFED shall not be liable for any loss or damage caused or alleged to be caused by or in connection with use of or reliance on any content, goods, or services available on or through any other website or resource.
    1. Any concerns regarding external links on the ALLFED Website should be directed to us via the Contact Us page form. 
    2. Any concerns regarding the content or operation of any external links should be directed to its respective website administrator or webmaster.

Liability

  1. You are responsible for ensuring that your computer system meets all relevant technical specifications necessary to use the Website and is compatible with the Website.  We do not guarantee that any material available from the Website will be free from infection, viruses, and/or other code that has contaminating or destructive properties. You are responsible for implementing sufficient procedures and virus checks to satisfy your requirements.
  2. In circumstances where you suffer loss or damage arising out of or in connection with the use of the Website, we accept no liability for this loss or damage.
  3. To the fullest extent permitted by law, ALLFED and our stakeholders shall not be liable to you or any third party for any direct, special, incidental, consequential, punitive, or indirect damages. This includes, without limitation, damages for personal injury, lost profits, lost data, and business interruption arising from the use of, or inability to use, the site, even if ALLFED has been advised of the possibility of such damages. In any event, the total liability of ALLFED and its stakeholders for all damages, losses, and causes of action shall be limited to the amount paid by you, if any, for access to the Website.
  4. The limitations and exclusions in this clause do not affect your non-excludable statutory rights and only apply to the extent permitted by applicable law.

Indemnification

  1. Except to the extent prohibited by law, you agree to defend, indemnify, and hold harmless ALLFED from and against any claims, demands, actions, suits, liabilities, damages, losses, costs, penalties, fines, and settlements (including reasonable attorneys' and experts' fees) arising out of or relating to:
    1. your violation of these Terms;
    2. your use of, or activities in connection with, the Website;
    3. your donations through the Website or to ALLFED; or
    4. your violation of any Law or the rights of a third party, including Intellectual Property Rights.
  2. You may not settle or otherwise compromise any claim, demand, action, or suit covered by the above indemnification without ALLFED’s prior written consent, not to be unreasonably withheld.

General

  1. We may assign, transfer, novate, or subcontract any or all of our rights and obligations under these Terms and Conditions at any time.
  2. These Terms and Conditions, together with the Privacy Policy and Cookie Policy, are the whole agreement between you and ALLFED.
  3. You acknowledge that you have not entered into this agreement in reliance upon any statement, warranty, or representation made by ALLFED or any other person, and you irrevocably and unconditionally waive any rights to claim damages and/or to rescind these Terms and Conditions by reason of any misrepresentation (other than a fraudulent misrepresentation) that is not contained in the Terms and Conditions, Privacy Policy, or Cookie Policy.
  4. If any provision or term of these Terms and Conditions shall become or be declared illegal, invalid, or unenforceable for any reason whatsoever, such term or provision shall be divisible from the other Terms and Conditions and shall be deemed to be deleted from them.
  5. These Terms and Conditions and your use of the Website are governed by U.S. laws and, where applicable, laws relevant to jurisdictions of other ALLFED entities, and you submit to the non-exclusive jurisdiction of the U.S. courts and, where applicable, courts relevant to jurisdictions of other ALLFED entities.
    1. These Terms and Conditions do not confer any rights on any person or party (other than you and/or us) pursuant to the UK’s Contracts (Rights of Third Parties) Act 1999.
  6. Except in respect of a payment obligation, neither you nor ALLFED will be held liable for any failure to perform any obligation to the other due to causes beyond your or ALLFED's respective reasonable control.
  7. Failure or delay by either party enforcing an obligation or exercising a right under these Terms and Conditions does not constitute a waiver of that obligation or right.

Notices

  1. All notices shall be given:
    1. to us via the form on the Contact page; or
    2. to you at the email address you provide when using the Website or subsequently update.
  2. Notice will be deemed received when an e-mail is received in full (or else on the next business day if it is received on a weekend or a public holiday in the place of receipt).
